GREATER CINCINNATI CREDIT UNION VISA CREDIT CARD AGREEMENT
OVERDRAFT PROTECTION AGREEMENT AND TRUTH-IN-LENDING DISCLOSURE STATEMENT
In this Agreement the words "you" and "your" mean each and all of those who apply for the card or who sign this Agreement. "We", "us" and "ours" means or refers to this Credit Union.
"Card" means the VISA CLASSIC Credit Card and any duplicates and renewals we issue. Account means your VISA Credit Card Line of Credit Loan Account with us. This Agreement
is a Truth-In-Lending Disclosure Statement, an Overdraft Protection Agreement as well as a contract.
1. ACCEPTANCE OF AGREEMENT. Your use of the Account or the Card by you or
anyone whom you authorize or permit to use your Account or the Card means you
accept this Agreement.
2. RESPONSIBILITY. You promise to repay all debts and the FINANCE CHARGE
arising from any authorized use of the card and card account. For example, you
are responsible for charges made by yourself, your spouse and minor children. You
are also responsible for charges made by anyone else to whom you give the card,
and this responsibility continues until the card is recovered. This includes all fees
assessed on the account by us. You cannot disclaim responsibility by notifying us,
but we will close the account for new transactions if you so request in writing and
return all cards to us. If this Agreement is signed by two persons, the Account is joint;
that is, each of you, separately and jointly with each other, is liable for all debts on the
Account and FINANCE CHARGE thereon. Your obligation to pay all such debts and
FINANCE CHARGE thereon continues even though an agreement, divorce decree or
other court judgment and/or order to which we are not a party may direct that only
one of you, or some person other than you (or both of you), must pay such debts and
FINANCE CHARGE.
3. PROMISE TO PAY. You agree to pay us in U.S. dollars for all purchases and cash
advances, including applicable FINANCE CHARGES and other charges or fees,
incurred by you or anyone you authorize or permit to use your Account or the Card,
even if you do not notify us that others are using your Account or the Card. If you pay
us in other than U.S. dollars, we may refuse to accept the payment or charge your
Account our cost to convert your payment to U.S. Dollars. All checks must be drawn
on funds on deposit in the U.S. We can accept late payments or partial payments or
checks and money orders marked "payment in full" without losing any of our rights
under this Agreement.
4. OVERDRAFT PROTECTION SHARE DRAFT ACCOUNT. In the event any authorized
person on your Share Draft Account writes a draft which would result in the Share
Draft Account being overdrawn, the overdraft may be deemed to be a request to
us for a Cash Advance under this agreement. There will be no fee imposed for this
service. However, Cash Advances are subject to a FINANCE CHARGE from the date
of posting and you must pay a cash advance fee (see paragraph 10.6).
5. CREDIT LIMIT. We have established a self-replenishing Line of Credit for you. The
approved Credit Limit is per account and not card. You agree not to let the account
balance exceed the approved Credit Limit. If your balance exceeds the approved
Credit Limit you agree to pay an Over-Limit Fee (see paragraph 10.1). Each payment
you make on the account will restore your Credit Limit by the amount of the payment
which is applied to principal. You may request an increase in your Credit Limit only
by applying to us (subject to credit approval). By giving you written notice, we may
reduce your Credit Limit from time to time, or with good cause, revoke your card
and terminate this Agreement. Good cause includes your failure to comply with
this Agreement, or our adverse reevaluation of your creditworthiness. You may also
terminate this Agreement at anytime, but termination by either os us does not affect
your obligation to pay the account balance. The card(s) remain our property and you
must recover and surrender to us all cards upon our request and/or upon termination
of this Agreement.
6. USING THE CARD. To make a purchase or cash advance, present the card to a
participating VISA plan merchant, to us, or to another fi nancial institution, and sign the
sales or cash advance draft which will be imprinted with your card. You will receive
a copy of the draft which you should retain to verify your monthly statement. We
will, upon request, furnish you with a copy of a draft and add a Document Fee (see
paragraph 10.3) to the total New Balance on you Account. Please note that we are
not responsible if a particular VISA plan merchant or fi nancial institution refuses to
honor your Card. From time to time certain countries or geographical regions may be
blocked for security reasons. If you are traveling and need more information, please

7. TEMPORARY HOLDS AND AUTHORIZATIONS FOR AMOUNTS IN EXCESS OF
TRANSACTIONS. To facilitate certain electronic transactions you make we may
place temporary holds on available funds associated with your line of credit. These
holds may be for periods of 36-hours or more; and are generously imposed by the
transaction networks that process your payment requests. The Credit Union can
neither control the parties with whom you do business nor regulate the processing
of transactions through the commercial networks used to facilitate your transactions.
Therefore, it is your obligation to insure that suffi cient funds associated with your line
of credit are available at all times to cover the transactions you make – including the
amount that may be subject to these holds. Pursuant to the processing networks
rules a merchant (hotel, car rental company, retailer, etc.) may obtain authorization
for up to 3 times the total estimated amount of your actual hotel stay, car rental or
purchase. This is deemed to be an "authorized amount" by you and the authorized
amount will not be available via your line of credit for 36 hours or more after your
bill is fi nally settled with such merchant(s), which can cause an unavailable funds
situation associated with your line of credit. Even if your bill is satisfi ed with another
form of payment, the merchant/retailer may continue to hold the funds as originally
authorized by you for these time periods.
8. MONTHLY STATEMENT OF ACCOUNT. We will send you after each monthly
Billing cycle date a statement. It will show your Previous Balance, current purchases,
cash advances, payments, credits, other debits, your credit limit, your unused credit
available, any charges for credit insurance coverage, your New Balance, the FINANCE
CHARGE due to date, and your Required Payment Due. Purchases will be identifi ed
by the amount and date of the transaction, the date of posting to your Account, the
merchant’s name and the city and state or foreign country where the transaction took
place. Cash advances will be identifi ed by the amount of the transaction, the date of
the transaction and the date of posting to your Account.
9. MONTHLY PAYMENT. Your Payment Due Date is 25 days after the Statement Date
irrespective of Saturdays, Sundays, or Holidays. The Required Payment Due is to
be in our offi ce on the Payment Due Date or before the Payment Due Date if it falls
on a Saturday, Sunday or Holiday. All payments are posted to your account on the
day received provided that day is a regularly scheduled business day The Required
Payment Due will be either (a) 2% of your New Balance, or $15.00, whichever is
greater plus any amounts past due, or (b) your full New Balance, if less than $15.00;
provided, however, the Required Payment Due shown on your statement will also
include any unpaid portions of Required Payments shown on earlier statements. In
addition, if at anytime your total New Balance exceeds your approved credit limit, you
must pay us that excess immediately as well as your required payment due. We will
apply your Required Payment Due fi rst to FINANCE CHARGES, Late Charges, Past
Due payments, Purchase Balance, then to the Cash Advance Balance. If you pay
your New Balance in full on purchases, with no Cash Advance Balances due, within
the Grace Period, no FINANCE CHARGES will be due. You may, of course, pay more
frequently, pay more than the Required Payment, or pay the New Balance in full, and
you will reduce the FINANCE CHARGE by doing so.
10. FINANCE CHARGE. Your Account will be subject to a FINANCE CHARGE
(interest): Tier A - an ANNUAL PERCENTAGE RATE of 11.9% with a periodic rate
of 0.9917% per month, Tier B - an ANNUAL PERCENTAGE RATE of 13.9% with a
periodic rate of 1.1583% per month and Tier C - an ANNUAL PERCENTAGE RATE
of 15.9% with a periodic rate of 1.3250% per month. Diamond Club members get a
2% discount on the VISA Card APR Rate. A Diamond Club Member is a member who
maintains with the Credit Union, share and checking accounts, a STAR ATM card and
a VISA card. No FINANCE CHARGE will be imposed if the a) previous balance shown
on the bottom of the statement is .00 or b) the sum of payments received with posting
dates equal to or prior than the due date are equal to or greater than the previous
balance and there are no cash advance balances due. FINANCE CHARGES will be
imposed if a) the sum of credit received is less than the previous statement’s balance
or b) all or part of the credit card balance is considered as a cash advance.
11. FEES. All fees added to your account will be subject to a FINANCE CHARGE until
the account is paid in full.
11.1 OVER-LIMIT FEE. You agree that the total amount of Cash Advances and
Purchases shall not exceed the maximum Credit Limit (see paragraph 5) authorized
by the Credit Union on the Account. However, if the Total New Balance on your
Account at any time during the Billing cycle exceeds the maximum approved Credit
Limit we have the right to assess an Over-Limit Fee of 10% of the amount you are
over your Credit Limit and add the fee to your Total New Balance for that Billing
cycle. This fee will be charged for each Billing cycle you are over your Credit Limit.
We may change the Credit Limit on an Account at any time, but the Credit Union shall
not knowingly reduce the Credit Limit below the current outstanding balance of the
Account and charge you an Over-Limit Fee. We do not waive any of our remedies
under this Agreement by charging an Over-Limit Fee.
11.2 REISSUE FEE. In the event any additional or replacement card(s) is issued for
any reason other than issuance of a renewal Card, a reissue fee in the amount of
$5.00 per card will be imposed which will be added to the Total New Balance for that
Billing cycle unless a Police Report substantiates that the loss of the card was a direct
result of a criminal act.
11.3 DOCUMENT FEE. If a copy of any monthly statement, sales draft or similar document is provided by us at your request (other than in connection with billing error
inquiries or resolution), a document fee in the amount of $3.00 for each document
reproduced will be imposed which will be added to the Total New Balance for that
Billing cycle.
11.4 LATE FEE. If the Required Payment Due is not received within 10 days after
any Payment Due Date, a late payment charge of $30.00 will be imposed and will be
added to the Total New Balance for that Billing cycle.
11.5 NSF PROCESSING FEE. If any draft, check or other instrument given for
payment on the Account is dishonored for any reason, a processing fee of $20.00 will
be imposed and will be added to the Total New Balance for that Billing cycle.
11.6 CASH ADVANCE FEE. Each time you use your card to make a Cash Advance,
other than at the Credit Union, a $2.00 fee will be imposed and added to the Total New
Balance for that Billing cycle. Cash Advances are subject to a FINANCE CHARGE
from the date of posting.
11.7 ATM Operator/Network Fees. When you use an ATM not owned by us, you may
be charged a fee by the ATM operator or any network used (and you may be charged
a fee for a balance inquiry even if you do not complete a fund transfer).
12. CREDITS. If merchants who honor your Card give you a credit for returns or
adjustments, they will do so by sending us a credit slip which we will post to your
Account. You should keep your copy of the credit slip to verify your monthly statement.
If your credits and payments exceed what you owe us, we will carry a credit balance
on the account.
13. SHARE SECURED VISA. You and any co-applicant, having a Share Secured VISA,
hereby pledge the shares on deposit in your designated share account as security for
the Share Secured VISA. You authorize us to apply such shares to payment of any
obligations should your Share Secured VISA be in default.
14. CANCELLATION. You may cancel your Account by notifying us in writing and
returning the Card to us cut in half. Of course you will still be responsible to pay any
amount you owe us according to terms of this Agreement.
15. LOSS OR THEFT OF CARD. You may be liable for the unauthorized use of your
card. You will not be liable for unauthorized use that occurs after you notify us either
orally at (513) 559-1234 or in writing at: VISA Department, Greater Cincinnati Credit
Union, 2721 Central Parkway, Cincinnati, OH 45225 of the loss, theft of possible
unauthorized use.
16. EFFECT OF AGREEMENT. This Agreement is the contract which applies to all
transactions on your account even though the sales, cash advances, or credit slips
you may sign may contain different terms. We may amend this Agreement from time
to time by sending you the advance written notice required by law. Your use of the
card thereafter will indicate in our notice, amendments will apply to your existing
account balance as well as to future transaction.
17. DEFAULT. The Required Payment Due shown on the statement is due on or
before the Payment Due Date (See paragraph 8). However, you will only be in default
if you fail to make the Required Payment Due within 25 days after the Payment Due
Date as shown on the statement. You will also be in default (a) if you breach any
other conditions of the Agreement, (b) if we determine that your creditworthiness
(which includes your ability to repay us) has become unsatisfactory due to change in
employment, increase in your other obligations, or because of any other reason, or (c)
in the even of your death. In the event of any default or in the event this Agreement
is terminated by you or by us for any reason, the entire balance on the Account
becomes due and payable forthwith. You also agree that, in case of default, you will
pay all usual and customary costs of collection permitted by law.
18. CREDIT INFORMATION. You authorize us to investigate your credit standing
when opening, renewing or reviewing your account, and you authorize us to disclose
information regarding your account to credit reporting agencies.
19. CASH ADVANCE BY MACHINE. We will furnish you with a personal indentifi cation
number. Your use of that number, together with your Card, in getting a cash advance
from an Automated Teller Machine (ATM) is agreed to constitute your signature for
purposes of such cash advance. Minimum amount of cash advance is $50.00.
20. CHANGE OF ADDRESS. You must give us at least 20 days written notice prior
to a Billing Date of any change in your mailing address if we are to mail your billing
statement to your new address in a timely manner. Notify us by writing to the address
shown at the top of your statement.
21. APPLICABLE LAW. This Agreement, except to the extent that federal law is
applicable, shall be governed by the laws of the State of Ohio. If any term of this
Agreement is determined to be unenforceable by a court, the remaining terms will
remain in effect.
22. ILLEGAL TRANSACTIONS. You warrant and agree that your Credit Card Account
will not be used to make or facilitate any illegal transaction(s) as determined by
applicable law; and that any such use, including any such authorized use, will
constitute an event of default under this Agreement. You agree that the Credit Union
will not have any liability, responsibility or culpability whatsoever for any such use
by you or any authorized user(s). You further agree to indemnify and hold the Credit
Union harmless from any suits, liabilities, damages or adverse action of any kind that
results directly or indirectly from such illegal use.
23. EXCHANGE RATE. If a transaction is made in a foreign country or initiated in a
foreign currency, VISA International will convert the transaction to a U.S. dollar amount
in accordance with their operating regulations or conversion procedures in effect at
the time the transaction is processed. As of April 2, 2005, the exchange rate between
the transaction currency and the billing currency used for processing international
transactions is either (1) a rate selected by VISA from the range of acceptable rates
in wholesale currency markets for the applicable central processing date, which rate
may vary from the rate VISA itself receives or (2) the government-mandated rate in
effect for the applicable central processing date. The foreign currency conversion rate
in effect on the applicable processing date for a transaction may differ from the rate
in effect on the sale or posting date on Your billing statement.
